Terms of Service

1. Acceptance of Terms

By creating an account, accessing, or using Montty Finance ("Montty", "the Service", "we", "our"), you agree to be legally bound by these Terms of Service. If you do not agree to these terms, you must not use the Service. Your continued use of Montty constitutes acceptance of any updates to these terms.

2. Service Description

Montty Finance provides a financial management platform for startup founders and small businesses, including:

• Revenue, expense, and customer tracking
• Financial metrics calculation (runway, burn rate, churn, MRR)
• AI-powered CFO chatbot for financial insights
• Receipt scanning and OCR processing
• Financial health scoring and reporting
• Asset and liability management

3. Account Registration

To use Montty, you must:

• Be at least 18 years old
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Be responsible for all activities under your account

You may not share your account with others or create multiple accounts. We reserve the right to suspend or terminate accounts that violate these terms.

4. Subscriptions & Billing

4.1 Plans

Montty offers Free and Pro subscription plans. Pro plans are billed monthly or annually in advance.

4.2 Payment

• Payments are processed securely through Dodo Payments
• You authorize us to charge your payment method for all fees
• Prices are subject to change with 30 days notice
• Failed payments may result in service suspension

4.3 Cancellation & Refunds

• You may cancel your subscription at any time from your account settings
• Cancellations take effect at the end of the current billing period
• No refunds are provided for partial billing periods
• Upon cancellation, you retain access until the end of your paid period
• We reserve the right to offer refunds at our discretion

5. User Responsibilities

You agree to:

• Provide accurate financial data and information
• Use the Service only for lawful purposes
• Not attempt to reverse engineer, hack, or compromise the platform
• Not use the Service for illegal activities including fraud, money laundering, or tax evasion
• Not upload malicious code, viruses, or harmful content
• Not scrape, copy, or redistribute our content without permission
• Comply with all applicable laws and regulations

6. AI & Data Accuracy

Montty utilizes our proprietary artificial intelligence infrastructure, powered by our custom-built financial database and specialized know-how in startup finance and CFO best practices. Our AI system is designed specifically for financial analysis and insights tailored to founders and small businesses. However, AI can make errors. You are solely responsible for verifying all AI-generated data, calculations, and recommendations before making business decisions or filing taxes. We do not guarantee the accuracy, completeness, or reliability of AI outputs.

7. Intellectual Property

All content, features, and functionality of Montty (including but not limited to software, text, graphics, logos, and AI models) are owned by Montty Finance and protected by copyright, trademark, and other intellectual property laws.

You retain ownership of your financial data. By using Montty, you grant us a license to process, store, and analyze your data solely to provide the Service.

8. Data Privacy

Your use of Montty is also governed by our Privacy Policy. We collect, use, and protect your data as described in our Privacy Policy. By using the Service, you consent to our data practices.

9. Service Availability

We strive to provide reliable service but do not guarantee uninterrupted access. Montty may be unavailable due to maintenance, updates, or technical issues. We are not liable for any losses resulting from service downtime.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• Montty is provided "AS IS" without warranties of any kind
• We are not liable for any indirect, incidental, special, consequential, or punitive damages
• We are not responsible for financial losses, tax penalties, business decisions, or data loss
• Our total liability shall not exceed the amount you paid us in the past 12 months
• We are not liable for third-party services (Supabase, Gemini AI, Dodo Payments, etc.)

11. Indemnification

You agree to indemnify and hold harmless Montty Finance, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any rights of another party.

12. Termination

We reserve the right to suspend or terminate your account at any time for violations of these Terms, fraudulent activity, or any reason at our discretion. Upon termination, your right to use the Service ceases immediately. You may request a data export before termination.

13. Modifications to Terms

We may update these Terms at any time. Significant changes will be communicated via email or platform notification. Continued use of Montty after changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by and construed in accordance with applicable laws. Any disputes shall be resolved through binding arbitration or in courts of competent jurisdiction.

15. Beta Features

Some features may be offered as "beta" or experimental. These features are provided as-is and may be modified or discontinued at any time without notice.
